<br> to apply to establish Guthi
A person who wants to establish a Guthi should submit an application to the Registrar with the following details:-
(a) the value of the property held for sale and the details thereof,
(b) details of the beneficiary and the benefits, facilities, conditions and extent thereof,
(c) Matters relating to the establishment of Guthi for a specific period of time,
(d) Other necessary details.
(2) When making an application according to sub-section (1), the following documents should also be submitted along with the application:-
(a) Certificate of Incorporation of Guthi,
(b) The name of the Guthi operator and a copy of the document relating to his approval,
(c) Copy of such document, if any, to establish the Guthi (d) A reliable document regarding the identity of the founder of the Guthi and if any organized organization is the founder of the Guthi, a certified copy of the document related to the establishment of such an organized organization and a certified copy of the decision of such an organized organization regarding the establishment of the Guthi,
(E) Receipt of payment of the fee required by law for registration of Guthi.
(3) "Registrar Officer" shall mean the officer who has been provided under the law for the registration, supervision and cancellation of Guthi and the term shall refer to the relevant District Property Officer in case there is no such provision.
(4) "Guthi trustee (trustee)" means a person who has the responsibility of operating and managing the Guthi property.
(5) Notwithstanding anything written in sub-section (1), if a person arranges to operate and manage his rights, enjoyment and property in the form of a donation in accordance with his verbal behavior, conduct or after his balance, such behavior, conduct Or it will be considered that the Guthi has been established according to the donation. However, in the case of the property that needs to be registered in order to transfer the rights according to the law, the relevant document must have been passed.
(6) If a foreigner wishes to establish a Guthi, as per sub-sections (1) and (2).The application should be submitted after completing the process. A foreigner can be a founder in a Guthi established in that way. However, a foreigner cannot establish a Guthi to fulfill the purpose of Clause (l) of Sub-section (2) of Section 315.
(7) At least one-third of the directors of Guthi established under sub-section (4) must be Nepali citizens who have permanent residence in Nepal.
